Joint victory of the tax practices and the law firm

MDDP won before the Voivodship Administrative Court in Szczecin after the delivery of the January judgment of the Supreme Administrative Court regarding a shopping centre.

This time the case concerned a tax on civil law transactions. The court ruled that since the sale of a shopping mall is not treated as a sale of an enterprise, but as a sale of real estate, the taxpayer has the right to recover VAT paid and does not have to pay tax on civil law transactions.

Also in this case, the Voivodship Administrative Court acknowledged the arguments of MDDP’s attorneys as to the merits and granted the right to protection under the received advanced tax ruling.
